These Terms of Use ("Agreement") govern your use of vitalistbay.com ("Site"), the Vitalist Bay 2026 mobile application ("App"), and any related products and services (collectively, the "Service"). The Service is operated by Vitalism International Foundation, 954 Ponce de Leon Ave., Miramar Plaza Suite 806, San Juan, PR ("we", "us", "our"). Vitalist Bay 2026 is a four-day longevity event held at Lighthaven, Berkeley, May 14–17, 2026.
By accessing or using the Service you agree to be bound by this Agreement. If you do not agree, do not use the Service. If you are entering this Agreement on behalf of an organization, you represent that you have authority to bind that organization, in which case "you" refers to the organization.
You must be at least sixteen (16) years of age to use the Service. By using the Service you represent and warrant that you meet that requirement. The App is restricted to individuals who hold an active ticket to Vitalist Bay 2026; access is verified by email-based one-time-code login against our registration database.
All purchases of Vitalist Bay 2026 event tickets are subject to the following refund policy:
All refund requests must be submitted in writing to ops@vitalismfoundation.org. Refunds are processed to the original payment method within fourteen (14) business days of approval. Complimentary tickets and tickets obtained through promotional codes at no cost are not eligible for refunds. We reserve the right to cancel or reschedule the event, in which case a full refund will be issued to all ticket holders. Ticket transfers to another person may be permitted at our discretion as an alternative to a refund.
The App is provided as a complimentary companion to your event ticket. By using the App you agree to:
You retain ownership of content you submit to the Service (profile information, direct messages, Gallery photos, captions, session ratings). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute that content as required to operate the Service.
You are solely responsible for content you submit. By submitting it you represent and warrant that:
We reserve the right — but have no obligation — to review, moderate, or remove user-generated content at any time, with or without notice. Gallery photos are reviewed by a moderator before publication; direct messages may be reviewed only when reported or flagged for abuse.
You may not use the Service:
We reserve the right to revoke your access to the Service for any violation of these Prohibited Uses, with or without notice, and at our sole discretion.
Vitalist Bay 2026 enforces the Vitalism Foundation Code of Conduct on-site and inside the App. Harassment, discrimination, and unsafe behavior will result in removal from the event without refund and, where applicable, a permanent ban from future Vitalism Foundation events.
The Service may link to external websites and services. We are not responsible for the content, privacy practices, or terms of any third-party site. Your use of any third-party resource is at your own risk.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, that defects will be corrected, or that the Service is free of viruses or other harmful components.
To the fullest extent permitted by applicable law, in no event will Vitalism International Foundation, its affiliates, directors, officers, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, punitive, cover, or consequential damages (including lost profits, revenue, sales, goodwill, use of content, business interruption, or loss of anticipated savings) however caused, under any theory of liability — even if advised of the possibility of such damages. To the maximum extent permitted by law, our aggregate liability relating to the Service is limited to the greater of one US dollar ($1.00) or the amount you paid us in the prior twelve (12) months for the goods or service giving rise to the liability.
You agree to indemnify, defend, and hold harmless Vitalism International Foundation and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or connected with: (a) your use of or access to the Service; (b) your violation of this Agreement; (c) your violation of any third-party right; or (d) any content you submit through the Service.
We may modify this Agreement at any time. When we do, we will revise the "Last updated" date at the top of the page and, for material changes, post a notice on this page or notify you by email. Your continued use of the Service after the effective date constitutes acceptance of the revised Agreement.
This Agreement is governed by the laws of the Commonwealth of Puerto Rico and applicable U.S. federal law, without regard to conflict-of-laws principles. Any dispute arising out of this Agreement or your use of the Service will be resolved in the courts located in San Juan, Puerto Rico, unless mandatory consumer-protection law in your jurisdiction provides otherwise.
If any provision of this Agreement is held unenforceable, the remaining provisions will continue in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving the parties' intent.
By accessing or using the Service you acknowledge that you have read this Agreement and agree to all of its terms and conditions. If you do not agree, you are not authorized to access or use the Service.
